1. Introduction

1.1 , VAT number 02218760565 (hereinafter referred to as "Ink Solution Srl").

These General Conditions are the only ones that can be applied and replace all other conditions, except for preliminary, express and written exceptions. Ink Solution Srl may find itself obliged to modify some of these provisions; Customers are therefore advised to read the General Conditions each time they visit the Inkpro.it website (hereinafter referred to as "the Site"). These changes are enforceable from the time they are put online and are not applicable to contracts stipulated prior to their publication. Every purchase on the Site is subject to the General Conditions of Sale applicable on the date of the order. Ink Solution Srl trusts that, once the order has been validated, the Customers have read and accepted the General Conditions of Sale without reservation. Customers undertake to respect the General Conditions and Conditions of Use found on the website www.Inkpro.it .

2. Place an order

3. Prices

The sales prices indicated on the Site are expressed in euros (€) and include VAT, but may not include delivery costs. Delivery costs are normally always borne by the Customers, unless "free shipping" is expressly indicated.

Ink Solution Srl reserves the right to change prices at any time, but undertakes equally to apply the prices indicated on the Site at the time the order is placed.

If an incorrect and/or manifestly negligible price is displayed, for any reason (IT bug, manual error, technical error...), the order will be cancelled, even in the event of initial validation.

4. Availability

Customer orders are fulfilled within the limits of the quantity of products available. In the event of unavailability of a product we will refund the price of that product within a maximum of 14 days .

In the event that only some of the products ordered are not available, Ink Solution Srl undertakes to immediately ship the available products and to bear the delivery costs relating to the shipping of the remaining products. In the event that the unavailability of the product is due to a definitive stop in its production by the manufacturer, Ink Solution Srl will offer the customer a product of equivalent quality and price. In case of refusal by the customer, Ink Solution Srl will refund the unavailable product. In the event that the customer wishes to return the product on the basis of the conditions set out in article 8 - Right of withdrawal - the return costs will be borne by Ink Solution Srl.

5. Delivery

The products purchased on the Site can be delivered throughout Italy, including the islands.

The order will be delivered to the address indicated at the time of its execution. Ink Solution Srl does not deliver to post office boxes.

If the item is available in stock, the expected delivery date is determined by the combination of the following 2 elements:

1. Shipping time (24 hours): verification of the reliability of the information provided when settling the account (see Article 7) + preparation of the order + management of the package(s) by the carrier

2. the delivery time of the package by the carrier chosen by the Customers.

Ink Solution Srl advises Customers to verify that the products delivered comply with the order and to indicate, if they are damaged, any anomalies on the delivery form in the form of handwritten and countersigned reservations.

Without prejudice to applicable legal guarantees, Ink Solution Srl advises Customers to address their reservations as soon as possible:

- by email using the contact form.

In the event of failure to receive a package within the expected time, the Customer will be invited to report this disservice to Ink Solution Srl, so that an investigation can be conducted in this regard. This could last several days (e.g. 21 days for Swiss Post, 21 days for GLS).

6. VAT refund

In compliance with Article 151 of Directive 2006/112/EC, deliveries of goods may be exempt from VAT.

Deliveries of goods requested by members of the following organizations may be subject to VAT reimbursement:

Deliveries of goods requested for official use by:

1. Foreign diplomatic missions

2. Foreign consular representations

3. European organizations to which the Protocol on the Privileges and Immunities of the European Union applies

4. International organizations

5. Armed forces of a State party to the North Atlantic Treaty (NATO forces)

Deliveries of goods requested for private use by:

1. Members of a foreign diplomatic mission

2. Members of a foreign consular representation

3. Staff of an international organization (and their family members living under their roof)

In order to obtain a VAT refund, interested parties must forward to Ink Solution Srl the VAT exemption certificate duly endorsed by the competent authorities of the country in which they are based, together with a declaration of conformity. 7. Secure payments

Ink Solution Srl has partnered with financial partners to guarantee the security of payments.

Ink Solution Srl offers its customers various payment options: bank transfer, PayPal, cash on delivery, credit card, prepaid card.

In the event that there are suspicions of fraud relating to a specific payment, the latter may be canceled without notice, by giving appropriate communication on the customer's email.

In the event of an automatic alert triggered by information regarding your order, our fraud prevention service may ask you for additional information and supporting documents (such as a copy of your identity card, proof of address,...) on the basis of which Ink Solution Srl will be able to validate or cancel your order.

In this case, in order to ensure the shipment of your order within the established times, we recommend that you indicate a telephone number at which you can be easily reached and that you confirm the information entered or send back the requested documents as soon as possible.

8. Right of withdrawal

Pursuant to art. 64 and following of D.Lgs. no. 206/2005, if the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number in the order form), he has the right to withdraw from the purchase contract for any reason, without any penalty and without prejudice to what is indicated in the following point 3. Therefore in compliance with the art. on the right of withdrawal Legislative Decree n°21 of 21 February 2014 - Implementation of EU Directive 2011/83 on consumer rights, amending Directives 93/13 EEC and 1999 /44/EC and repealing Directives 85/577 EEC and 97/7 EC - The legal period for exercising the right of withdrawal is 30 calendar days from the day of receipt of the goods by the consumer if the information obligations have been satisfied. If this deadline expires on a Saturday, Sunday or on a public holiday or non-working day, it will be extended until the first following working day. The customer who returns the product in exercising his right of withdrawal has: the right to a refund of the price of the product(s) ordered, except return shipping costs, within 14 days.
At the proposal of Ink Solution Srl, the customer who has exercised the right of withdrawal can, however, opt for an exchange or a credit note.

In order to correctly exercise your right of withdrawal you must inform us of your wish within a maximum of 30 days.

We strongly recommend that you notify us of your decision on the Site within your personal CONTACT US area or by writing an email to ordini@inkpro.it.

You can also inform us by sending the standard withdrawal form to Customer Service, filled in by yourself, or by another means of your choice, indicating your IBAN code to make the refund transfer.

From the date on which you inform us of your wish to exercise your right of withdrawal, you will have a maximum of 30 calendar days to return the products in question to us.

The return costs will be borne by us only if you decide to use our courier.

The right of withdrawal is subject to the following mandatory conditions:
- the right applies to the product purchased in its entirety. It is not possible to exercise withdrawal only on part of the product purchased e.g.: accessories;
- the company Ink Solution Srl, for the purposes of the applicability of the right of withdrawal in the distance contract as provided for by the D.Lgsl. 206/2005, informs the customer that the goods sold will be considered substantially intact, pursuant to art.67 c.2 D.Lgsl. 206/2005, only in the event of failure or failure by the buyer to open the relevant packaging;
- the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc...); To limit damage to the original packaging, we recommend, when possible, placing it in a second box, on which to affix the RMA number (return authorization code) issued by "Ink Solution Srl". In all cases, affixing labels or adhesive tapes directly to the original packaging of the product should be avoided;
- the goods subject to the exercise of the right of withdrawal must bear the same serial number present on the sales invoice; if the good shows a serial number different from that indicated on the invoice, the return will not be accepted and the product will be made available to the Customer for its return, simultaneously canceling the withdrawal request;
- the shipment, until receipt is certified in our warehouse, is under the complete responsibility of the customer;
- in the event of damage to the goods during transport, Ink Solution Srl will notify the Customer of the incident (within 5 working days of receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen and obtain reimbursement of the value of the property (if insured); in this case, the product will be made available to the Customer for its return, simultaneously canceling the withdrawal request;
- Ink Solution Srl is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments;
- the goods subject to the exercise of the right of withdrawal must return to our warehouse within 10 calendar days from the date of authorization for return, after this deadline the shipment will be rejected and at the same time the withdrawal request will be cancelled.
In case of partial withdrawal of the order, the customer who benefited during the initial order from free shipping, for having exceeded a minimum order value, may be charged the shipping costs corresponding to the order placed if the latter is of less value than the minimum purchase required to qualify for free shipping.

Ink Solution Srl, for the purposes of the applicability of the right of withdrawal in the distance contract as provided for by the D.Lgsl. 206/2005, informs the Customer that the purchased good will be considered substantially intact, pursuant to art. 67 c. 2 D.Lgsl. 206/2005, only in the event of failure or failure by the buyer to open the relevant packaging and brand seal. In the event of forfeiture of the right of withdrawal, Ink Solution will return the purchased goods to the sender, charging the shipping costs to the sender.

You have a statutory right of withdrawal of 30 calendar days to cancel all or part of your order. This period begins from the moment of receipt of your order or of the last package forming part of your order, if this was delivered to you in multiple packages.

Ink Solution Srl undertakes to reimburse you for the returned products and the related delivery costs (not the return shipping costs if you have used a courier other than ours) through the payment method initially used as soon as it receives the products or proof of their shipping.

We inform you that Ink Solution Srl may reduce the amount refunded in the event that the value of the product has been devalued following operations other than those usually necessary to establish the nature, characteristics and correct functioning of the product.

We remind you that the right of withdrawal generally does not apply to the following cases:

- products that may deteriorate or expire soon;

- sealed products which cannot be returned for hygiene reasons and which have been opened by the consumer after delivery;

- sealed audio or video recordings or sealed computer software that has been opened after delivery.

9. Reshipment of the products

We inform you that the products must be returned to the following address:

Inside the package you will find a GLS form with which you can make a return with shipping paid by us. Once filled in with all the data you can contact the nearest GLS center and request collection.

The Customer must send a preventive email, in which he informs us of the shipment of the goods, in order to avoid delivery problems.

10. Product warranties

The products offered for sale on the Site are accompanied by different types of commercial guarantees defined below. It is specified that the signing by the customer of these commercial guarantees does not prejudice the application, for any item sold on the Site by Ink Solution Srl, of the legal guarantee of conformity in compliance with the following legal conditions.

Based on the legal guarantee of conformity, Ink Solution Srl undertakes to deliver an order that complies with the concluded sales contract and to be liable for any defects of conformity found at the time of delivery.

To comply with the contract, the products must:

1) correspond to the description on the Site at the time the order was placed;

2) be suitable for any use for which products of the same type are usually used or for any other special use sought by the Customer, of which Ink Solution Srl has been informed and to which it has formally consented;

3) present the usual quality and performance of a product of the same type, which the consumer can reasonably expect, taking into account the nature of the product and the characteristics described on the Site.

In the event of a clear lack of conformity, it will be necessary to restore the conformity of the defective product, at no cost to the Customer.

Please note that this legal guarantee covers any lack of conformity manifested within a maximum of 2 years from the date of delivery of the order with the following limits:

- consumables for laser technology peripherals: 12 months
- consumables for ink-jet peripherals: 3 months

Furthermore, please note that the legal guarantee may not apply or apply only partially in the following cases:

- The repair of damage caused by a cause external to the product (for example: accidents, impacts, lightning, power surges, oxidation, presence of sand...),

- A Customer error resulting, for example, from use or installation that does not comply with the manufacturer's specifications,

- Use of the appliance that is harmful to its maintenance,

- Any lack of conformity of which the customer was aware at the time of placing the order.

Commercial guarantees provided by the product manufacturers (defective product):

In addition to legal guarantees, some goods sold on the Site are provided with a manufacturer's guarantee, with different validity and duration depending on the products and brands.

Generally, manufacturer warranties do not cover:

- The replacement of consumable elements (batteries, light bulbs, fuses, wear of recording or reading heads...);

- Abnormal or non-compliant use of the products;

- Damage due to the intervention of a repairer not authorized by the manufacturer;

- Damage due to causes external to the appliance (for example: accidents, internal or external impacts, lightning, power surges, oxidation, presence of sand...).

The Customer is therefore invited to carefully consult the user manual supplied with the products and the exact terms of the manufacturer's warranty with which the products in question are possibly equipped.

In any case, Ink Solution Srl cannot be held responsible for any refusal by the manufacturer to apply its guarantee for the aforementioned reasons.

In the event that the manufacturer's warranty is not applicable, the manufacturer will prepare a quote. The manufacturer may require the payment of administrative costs if the customer requests the return of the product without the repairs proposed in this estimate. In this case, the Customer may also choose to abandon their product without additional costs.

The customer has 3 months to accept or reject the quote and pay any amount due. Beyond this deadline, the quote will be considered rejected and the material abandoned. In this case, no refund can be requested.

The After-Sales Service cannot guarantee the customer more than two consecutive deliveries for each product. In the event of double non-delivery (rejected parcel, impossible delivery...), the product will be left available to the customer at the Ink Solution Srl Logistics Center for 3 months. Beyond this deadline, the material will be considered abandoned. Ink Solution Srl will be able to dispose of it fully and absolutely, and proceed with its destruction. In this case, no refund can be requested.

11. Disputes and Liability

Ink Solution Srl cannot be held responsible for damages resulting from incorrect use of the products sold on the Site. In any case, Ink Solution Srl cannot be charged costs of any kind deriving from the failure to use the equipment for which the products were supplied to except those due to gross negligence.

12. Billing

Invoicing occurs automatically as soon as the payment is registered in our system. The invoice is sent via email and always remains available in your customer panel in downloadable PDF format.

In the case of B2B services to residents abroad, invoicing takes place without applying VAT, after verifying registration in the VIES register.

13. Comments, criticisms, communications

All customer opinions sent to Ink Solution Srl are monitored and moderated by the marketing office of Ink Solution Srl. In the event that said opinions are contrary to the law or morality (abusive advertising, defamatory intentions, insults, improper comments... ) Ink Solution Srl reserves the right to refuse or censor the opinion in question.

14. Privacy and processing of personal data:

Ink Solution Srl, with registered office in Via Garbini, 29g – 01100 Viterbo VT, and VAT number 02218760565 , as data controller, informs you that your personal data - collected directly from you - will never be transferred or distributed to third parties but used in full compliance with the fundamental principles, dictated by Directive 95/46/EC and by D.Lgs. 30 June 2003 N°196, as well as pursuant to art. 13 of Regulation (EU) 679/2016 (GDPR) relating to the protection of natural persons with regard to the processing of personal data.
